GCCA ends "Meditech-Georgia" complaint with commitments agreement

GCCA-მ „მედიტექ-ჯორჯიას“ საჩივარი პირობითი ვალდებულებების შეთანხმებით დაასრულა

The Georgian Competition and Consumer Protection Agency (GCCA) has concluded its review of a complaint against Meditech-Georgia LLC, in the market for medical-aesthetic and laser equipment, by signing a commitments agreement. The complaint concerned a suspected violation of the Law on Competition.

According to the agency, the case involved a post published on social media by a competing company, which discussed the manufacturer of a device and its technical characteristics. The complainant believed that the information in the post did not correspond to the truth and could create a false impression among consumers about both the technical characteristics of the device and the services provided using it.

The agency assessed the commitments offered by the respondent and considered that their fulfillment would be sufficient to eliminate the risk of a suspected violation of the law. Under the agreement, the respondent was required to delete the disputed publication within the period set by the agency. In addition, in the future, through mass communication channels, including Facebook and other social networks, it must not publish or disseminate information that casts doubt, without objective and verified evidence, on the characteristics, origin and/or sales conditions of the goods sold by the complainant or another competing economic agent.

According to the agency, the purpose of the commitments agreement is to eliminate the risk of a suspected violation of competition legislation and to promote a fair competitive environment in the market.
